1. Data Controller Designation

By posting a job advertisement on FULLTIMEZ, the Employer or Overseas Promoter ("you," "Employer") acknowledges and agrees that you are the Data Controller, as that term is defined under UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data ("PDPL"), in respect of any personal data of job applicants and candidates ("Candidate Data") that you collect, view, download, or otherwise process through your use of the FULLTIMEZ platform.

FULLTIMEZ acts solely as a technology platform that facilitates the connection between job seekers and Employers. FULLTIMEZ does not determine the purposes or means by which you process Candidate Data after it is made available to you, and accordingly does not act as a Data Controller in respect of your downstream use of that data.

2. Lawful Basis for Processing

You confirm that you have, and will maintain, a valid lawful basis under the PDPL for collecting and processing Candidate Data obtained through FULLTIMEZ, which may include:

  • the consent of the candidate, given at the point of application; or
  • the processing being necessary for the performance of, or steps prior to entering into, an employment contract with the candidate.

You are responsible for ensuring this lawful basis is properly documented and maintained in accordance with PDPL requirements.

3. Purpose Limitation

You agree to use Candidate Data solely for the purpose of recruitment in connection with the specific job advertisement to which the candidate applied, or for closely related recruitment purposes. Candidate Data must not be used for:

  • unrelated marketing or promotional purposes;
  • resale, rental, or transfer to third parties not involved in the recruitment process; or
  • any purpose beyond what a reasonable candidate would expect when applying to your advertised position.

4. Data Retention

You agree to retain Candidate Data only for as long as necessary to fulfil the recruitment purpose for which it was collected, in accordance with the PDPL storage limitation principle. Once that purpose has been fulfilled, you agree to securely delete or anonymize the Candidate Data, unless a longer retention period is required by applicable law.

5. Cross-Border Data Transfer Disclosure

You acknowledge that job advertisements posted by Overseas Promoters on FULLTIMEZ are made on behalf of principal employers located outside the United Arab Emirates. As a result, Candidate Data submitted in response to such advertisements may be transferred outside the UAE.

You agree to ensure that any such cross-border transfer of Candidate Data complies with the PDPL requirements, including obtaining the candidate informed consent to the transfer, or ensuring the receiving jurisdiction provides an adequate level of data protection.

6. Candidate Rights Cooperation

You agree to cooperate in good faith with any requests from candidates to exercise their rights under the PDPL, including the right to access, correct, or request deletion of their Candidate Data.

7. Security Obligations

You agree to implement reasonable technical and organizational security measures to protect any Candidate Data you access, download, or store, in order to prevent unauthorized access, disclosure, alteration, or loss.

8. Platform Limited Role and Liability

You acknowledge and agree that:

  • FULLTIMEZ is a job listing platform only;
  • the Employer or Overseas Promoter is solely and fully responsible for the content, accuracy, and legality of any job advertisement posted;
  • FULLTIMEZ accepts no liability or responsibility for job advertisements posted by Employers or Overseas Promoters; and
  • by posting a job advertisement, you authorize FULLTIMEZ to broadcast that advertisement both inside and outside the United Arab Emirates.
